1. Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country or jurisdiction of residence, or that you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose.
You must not transmit any worms, viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks.
Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission by us.

3. Technical Requirements

To use the website it is necessary to have a device with Internet access and an up-to-date web browser supporting cookies and JavaScript.
Some functionalities of the website may additionally require an active e-mail address.
This information is provided pursuant to Article 8(3)(2)(a) of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.

4. Products and Orders

Most products available in the store are manufactured or prepared on demand, including painting and finishing according to the selected configuration.
Most products available in the store are manufactured specifically for each order and therefore qualify as made-to-order or personalized products within the meaning of applicable consumer protection regulations.
Due to the nature of custom-made or limited-production automotive parts, lead times may vary depending on production complexity and stock availability.
All orders are subject to acceptance and product availability.

5. Shipping and Delivery

All orders are shipped from our logistics centers located within the European Union.
Estimated shipping times depend on the selected shipping method and destination country.
Delivery delays caused by customs procedures, courier disruptions, strikes or other circumstances beyond OctoClassic’s control shall not constitute grounds for compensation claims.
Any import duties, taxes or customs fees outside the European Union remain the sole responsibility of the customer.

6. Payments

Payments may be processed through supported payment gateways, credit cards or bank transfers.
When paying by card or electronic payment methods, currency conversion may be automatically processed by the payment operator.

7. Right of Withdrawal

Many products offered by OctoClassic are manufactured, painted, finished or otherwise customized specifically for the customer’s order.
In accordance with applicable consumer protection laws, including Article 16(c) of Directive 2011/83/EU, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized.
By placing an order for a made-to-order, customized, painted, finished or otherwise personalized product, the customer acknowledges that such products are exempt from the statutory 14-day withdrawal right.
For standard, non-customized products kept in stock and sold without personalization, consumers may exercise their statutory right of withdrawal within 14 days of receiving the goods.
The customer remains entitled to all statutory warranty and non-conformity rights applicable under consumer protection laws.

8. Price Reduction Information (Omnibus Directive)

For products marked as discounted, promotional or subject to a price reduction, the store displays the lowest price applicable within 30 days before the reduction was introduced, in accordance with applicable European Union regulations.
If the product has been available for less than 30 days, the lowest price since the beginning of the sale is displayed.
The lowest historical price is displayed directly next to the promotional price.

9. Returns and Complaints

Customers may submit complaints regarding defective or damaged products electronically.
Complaints are processed within a reasonable timeframe after receiving all necessary information.
Used, modified or improperly installed products may not qualify for warranty claims if the defect results from incorrect installation or misuse.

10. Customer Reviews in the Online Store

Customers of the Online Store may voluntarily and free of charge submit reviews regarding purchases made in the Online Store. A review may include an assessment, a photo, or a review of a purchased product.
After a purchase, the Seller transfers the data necessary to generate a review invitation email to the company responsible for the review collection process. The sending of review invitations and the collection process is fully handled by TrustMate S.A., with its registered office at Bartoszowicka 3, 51-641 Wrocław, Poland. TrustMate S.A. sends the Customer an email requesting a review along with a link to an online form enabling submission of the review. The form allows the Customer to answer questions regarding the purchase, rate it, add a written opinion, and attach photos of the purchased product. If the Customer does not submit a review after receiving the first invitation, TrustMate may resend the invitation.
A review may only be submitted by a Customer who has actually purchased products in the Online Store.
Submitted reviews may be published by the Seller in the Online Store and on TrustMate.io.
Reviews must not be used for unlawful activities, including acts of unfair competition against the Seller or actions violating personal rights, intellectual property rights, or any other rights of the Seller or third parties.
Reviews may only be submitted for products actually purchased in the Online Store. It is prohibited to create fictitious or sham sales transactions for the purpose of submitting a review. Reviews may not be submitted by the Seller or its employees, regardless of the basis of employment.
A submitted review may be deleted by its author at any time.

11. Limitation of Liability

We do not guarantee that use of our service will be uninterrupted, timely, secure or error-free.
OctoClassic shall not be liable for indirect, incidental or consequential damages arising from the use of the website, delays in delivery or improper installation of products.

12. Privacy and Personal Data

Personal data is processed in accordance with applicable GDPR regulations and the Privacy Policy available on the website.

13. Termination of Service

These Terms of Service remain effective unless terminated by either party.
We reserve the right to terminate access to the service in the event of violations of these Terms.

14. Applicable Law

These Terms and any separate agreements whereby we provide services shall be governed by and construed in accordance with the laws applicable within the European Union and the United Kingdom.

15. Changes to These Terms

We reserve the right to update, change or replace any part of these Terms by posting updates on our website.
It is the customer’s responsibility to check the website periodically for changes.
